Although most cases do involve or arise from vehicle accidents, the area of personal injury law is virtually unlimited in the cause that results in our clients being victims and entitled to justice through the legal process. Each and every case is different. Some of the common scenarios that lead to personal injury litigation are:

  • Premises liability (trip-and-falls as customers; workers on site; pet attacks visitor; landlord liability for defective flooring)
  • Fires/explosions/electrocutions (gas leaks at residence; workers injured on site or due to employer neglect; defective wiring; lack of safety precautions)
  • 18-wheeler/trucking (driver fatigue; inadequate hiring practices; poor truck maintenance; employer mandating safety violations)

Negligence or Intentional?

Personal Injury claims are the result of negligence or intentional acts. They may be acts or inactions, passive or aggressive. They may be committed by individuals, or perhaps a legal entity such as corporations or partnerships. There will usually be insurance (homeowner’s, auto, professional), but we are seeing more defendants go ‘bare’ and without any insurance, making recovery of damages something that must be evaluated at the beginning of the suit, not when judgment is obtained and after the expenditure of a great sum of money.

It is important to remember that a personal injury may be economic only, or in addition to what we commonly think of as physical, mental or emotional.
