Negligence or Intentional?

Personal Injury claims are the result of negligence or intentional acts. They may be acts or inactions, passive or aggressive. They may be committed by individuals, or perhaps a legal entity such as corporations or partnerships. There will usually be insurance (homeowner’s, auto, professional), but we are seeing more defendants go ‘bare’ and without any insurance, making recovery of damages something that must be evaluated at the beginning of the suit, not when judgment is obtained and after the expenditure of a great sum of money.

It is important to remember that a personal injury may be economic only, or in addition to what we commonly think of as physical, mental or emotional. We are prepared to thoroughly evaluate all possibilities for recovery, and to develop the case with retained expert assistance if needed. As each of our clients are unique, so are their injuries.

Examples

As an example, the stay-at-home mom who receives a broken leg due to defendant’s neglect is entitled to full compensation, but that compensation may be best measured by how it impairs her ability to care for her family during rehabilitation. The professional quarterback who receives the broken leg may have his compensation measured by how it shortens a very well-paying profession.  What is a small hand injury to an attorney is a very large hand injury to a surgeon.
